FEDERAL AND STATE ADMINISTRATIVE COURTS

With the 2012 Administrative Jurisdiction Reform (in force since 1 January 2014), a two-tier system of administrative jurisdiction was established in Austria. Decisions (Bescheide) of administrative authorities can first be challenged before the administrative courts. For this purpose, one administrative court was set up in each federal province, along with two federal administrative courts — the Federal Administrative Court and the Federal Finance Court (the so-called “9+2 model”). Decisions of these administrative courts can be appealed to the Administrative Court (Verwaltungsgerichtshof) and/or challenged before the Constitutional Court (Verfassungsgerichtshof).
