EUROPEAN COURT OF JUSTICE

The Court of Justice of the European Union (CJEU) in Luxembourg is the judicial authority of the European Union. It is divided into two courts: the Court of Justice and the General Court. It ensures the uniform interpretation and application of EU law across all Member States. The CJEU also adjudicates disputes between national governments and EU institutions.

What we do: Proceedings before the CJEU are particularly challenging. As a general rule, it is not possible to bring a case directly before the Court. Instead, a preliminary ruling procedure must be initiated, in which an Austrian court refers questions regarding the interpretation of EU law to the CJEU. The key is to present the EU law issue with precision and to draft the questions to the CJEU in such a way that the national court is compelled to make a referral. The oral hearings before the CJEU have their own distinct character: limited speaking time, no repetitions, meticulous objectivity, no theatrical advocacy, transcripts for interpreters — and much more.
