CONSTITUTIONAL COURT

The Constitutional Court (VfGH) is the guardian of the Constitution. If the legislature enacts a law that violates the Constitution, or if courts or administrative authorities take actions that infringe fundamental and human rights (referred to in the Austrian Federal Constitution as “constitutionally guaranteed rights”), individuals can bring a case before the VfGH — through an individual application, a party application for review of norms, or an appeal against a court ruling (Erkenntnisbeschwerde).
